If the Iphone 5 waits till 2012, and if it fails to be 4G (no matter when it comes) then Samsung is going to kick Apple senseless in the market. HTC will match Samsung step for step and Apple's marketshare will fall faster than stocks on Wall St.
Of course Apple knows it's going to be late and it's not going to be 4G, so that's why it's using the courts instead of the competing on the market.
